Meeting to approve new Disciplinary Scheme

Earlier this year, proposed changes to the Society’s Disciplinary Scheme were issued to members for consultation.  The main changes are:

1. Remove mediation from the Scheme
2. In relation to indictable offences, only those that would be indictable in Ireland to be taken into account for the purposes of establishing prima facie evidence of misconduct
3. More clarity on the rules about disclosure of determinations and sanctions
4. Permitting Tribunals to be held in virtual format
5. Requiring the Designated Staff Member to decline to act in the event of conflict of interest
6. Removing reference to Legal Advisers Pool - legal advisers to be decided as and when required
7. Correcting some typographical errors, including some incorrect use of capital letters.  Two further minor typographical corrections were made after the member consultation (at rules 8.17(a) and 9.2).

The proposed new Disciplinary Scheme is attached.  The meeting to approve the new Scheme will take place on Thursday, 16th June 2022, immediately after the Annual General Meeting on that date.  The meeting will be separate from the AGM in order to facilitate the process for approving changes to the Disciplinary Scheme set out in Article 42(b) of the Society’s Articles of Association.  As for the AGM, the meeting will be a hybrid meeting, run as a live webinar from the Radisson Blu Hotel, Golden Lane, Dublin 8.  Capacity at the venue will be very limited and we ask members to participate online, using Zoom.  If the new Disciplinary Scheme is approved by not less than 2/3rds of Fellows who vote on it at the meeting, it will come into effect on 17th June 2022.    

We invite members to register for and attend the Annual General Meeting and to remain online (a new dial-in will not be necessary) for the meeting on the Disciplinary Scheme.
